Trump's Framework of Consequences and Incentives

The ex-president's intense desire for retribution has rapidly morphed into a methodical framework. Over the past year, the leader's rage and caprices have adopted the form of administrative measures in a manner comparable to historical dictatorial governments. Government figures who resist his demands are immediately removed and replaced by loyalists. Critical figures who confront him face prosecution, judicial process and sanctions. Critics have been categorized under executive orders as “unpatriotic”, “against faith communities” and “opposing economic freedom”, and menaced with prosecution as “security threats”.

The Justice System Restructured

All case involving legal action of political opponents and leniency for his allies exhibits its own unique qualities. But, regardless of their individual nature, they represent manifestations of what has developed as a systematic method. These episodes are not isolated. Trump's cleansing of Department of Justice prosecutors and FBI officials, coupled with his placement of devotees in senior posts, started quickly, promptly developed a pattern, and has now been molded into a regime. Federal prosecutors and the Federal Bureau have been restructured into ideological agencies under Trump's direct command to implement his directives. Wrongdoing has been turned into normal. It represents the apparatus of revenge.

Administration is more concerned with penalizing the chief's perceived adversaries than they are with defending our national security.

Within the Structure

The beginnings of this mechanism has been uncovered in the legal complaint of several previous senior law enforcement executives filed in September in the US district court in Washington against top official an administration figure and justice department head another official for illegal termination in “a initiative of revenge against Plaintiffs for what administration figures judged to be a failure to show adequate devotion”. The document states that one official, the previous interim leader, recounts a exchange in which he “freely confessed the unlawfulness of his conduct”.

The official had tried to protect law enforcement officers from being fired, the lawsuit states. He told him that “administration officials” – understood by him to be the presidential administration and federal prosecutors – had instructed him to dismiss everyone who they identified as having worked on a criminal investigation against Trump. The document goes on: “The director explained that he had to terminate the people his leaders told him to remove, because his ability to retain his own job relied on the removal of the agents who worked on cases involving the chief executive. The director commented that there was nothing he or him could do to prevent these or any other dismissals, because ‘the FBI sought to place the President in jail and he hasn't forgotten it.’” Once the official told the director he was violating the agency's own policies, he allegedly said “he recognized that and he knew the character of the swift terminations were likely improper”.

Widespread Effects

After his claimed confession to the official, the DoJ and the FBI have been weakened and redirected for his revenge apparatus. Six of the bureau's high-ranking agents were dismissed or pushed out in the first days of the presidency. Roughly thousands of lawyers at the department have taken a “deferred resignation program”. No fewer than multiple federal prosecutors, among them those in the Manhattan division, quit in objection over what they considered as ideological pressure in dropping the criminal prosecution against the New York City mayor, a political figure, in return for his assistance with his federal agency detentions of immigrants. The anti-corruption unit of DoJ, which manages misconduct investigations, has been diminished to minimal staff. The rights protection unit has been devastated: the majority of its personnel has resigned. A third of executives at DoJ have left. The unit implementing ecological regulations has experienced the exit of half its supervisors.

Rewards and Penalties

In the legal matter, the interim prosecutor for the southern district of New York, she, quit in objection against what she characterized as the “trade-off”. A key figure, his “border czar,” was present as the agent with him on television to state: “Should he fail to deliver, I will return in NYC.”. Additionally, another figure, earlier the senior DoJ official and a past legal representative, who arranged the deal, was given an appellate federal judgeship, a possible springboard to the highest court.

Trump's protection for offenses committed while in power, provided by the unprecedented ruling of the conservative on the judicial body, thus blocking his legal action over the political violence and preserving his political viability for the 2024 election, is the cornerstone on which he relies to protect his loyalists. Given this protection, he has been freed to authorize misconduct. The consequence of the court judgment permeates his administration and the Republican Party thoroughly. The legal case has spread. In the words of Richard Nixon's White House counsel John Dean commented about the Watergate
